How to write

01.The identity of the preparer must be verified.

Since an Advance Directive on Life-sustaining Treatment should be written up by the preparer himself or herself, the registry agency may ask the person who wants to prepare the Advance Directive on Life-sustaining Treatment to present an ID card(legally effective certificate that can prove his or her identity within the Republic of Korea, such as a resident registration card or driver's license).

02.Advance Directive on Life-sustaining Treatment should be written after receiving sufficient explanation on following matters from Registry Agencies for Advance Directives and understanding the details.

  • Matters concerning the methods of implementing life-sustaining treatment and making a decision to withdraw or withhold LST
  • Matters concerning selecting and using hospice care
  • Matters concerning the validity and invalidity of advance directives on life-sustaining treatment
  • Matters concerning preparing, registering, keeping, and notifying the advance directive on life-sustaining treatment
  • Matters concerning amending and withdrawing advance directives on life-sustaining treatment and subsequent measures
  • Matters concerning transfer of the records in case the registry agency for advance directives is shut down/closed temporarily or designation is canceled

03.An Advance Directive on Life-sustaining Treatment must be prepared by the patient himself or herself.

The preparer must visit the Registry Agencies for Advance Directives designated by the Ministry of Health and Welfare. It can be handwritten on paper or can be created using a tablet.

04.Even though an Advance Directive on Life-sustaining Treatment has already been created, the preparer can amend or withdraw his or her intention at any time.

At this time, you do not have to visit the Registry Agencies for Advance Directives where you first created the document, but you can go to any Registry Agencies for Advance Directives designated by the Ministry of Health and Welfare.

05.Even if you wrote Advance Directive on Life-sustaining Treatment, it is invalid in any of the following cases.

  • 1Where it is not prepared in person by the preparer
  • 2Where it is not prepared according to the preparer’s voluntary intention
  • 3Where no explanation is provided on the matters that the preparer should know before filling out the form according to the Act or where no confirmation is obtained from the preparer
  • 4Where the life-sustaining treatment plan is prepared again after preparing and registering an advance directive on life-sustaining treatment
  • * The cases from no. 1 to 3 are not valid from the beginning, and in the case of no. 4, the Advance Directive on Life-sustaining Treatment loses its validity after the Life-sustaining Treatment Plan is prepared again.
